State court grants Simmonds & Narita’s anti-SLAPP motion in case alleging claims under California’s Identity Theft Act.

Simmonds & Narita obtained an order granting a Special Motion to Strike pursuant to section 425.16 of the California Code of Civil Procedure in the Unlimited Civil Division of the Contra Costa Superior Court.  The court awarded the firm’s client attorneys’ fees and costs against a plaintiff who alleged violations of California’s Identity Theft Act, Cal. Civ. Code § 1798.92, et seq. in connection with attempts to collect her delinquent credit account.
