Federal District Court grants Simmonds & Narita’s law firm client’s Motion to Dismiss for lack of personal jurisdiction
The United States District Court for the Northern District of Georgia granted Simmonds & Narita’s law firm client’s Motion to Dismiss for lack of personal jurisdiction. The Court held that Georgia’s long-arm statute does not extend to defendant’s activity in the state, because one email received by Plaintiffs in Georgia did not arise to a purposeful act or transaction in the state of Georgia. Because defendant’s actions did not fall within the long-arm statute, the court found that it lacked personal jurisdiction of defendant, and dismissed the action.
