State court grants Simmonds & Narita's anti-SLAPP motion in alleged "robo-signing" and "sewer service" putative class action.
Simmonds & Narita obtained an order granting the defendants' Special Motion to Strike pursuant to section 425.16 of the California Code of Procedure in the complex division of the Los Angeles Superior Court. The court awarded the defendants their attorneys' fees against a plaintiff who was pursuing a putative class action against a debt buyer. The court struck statutory and common law claims alleging improper service, filing of false affidavits, and fraudulently obtaining default judgments and writs of garnishment in collection lawsuits brought against California debtors.
