Simmonds & Narita obtained an order granting a defendant’s Motion for Summary Judgment in the San Luis Obispo Superior Court

The court held that since the finance company defendant directly extended credit to plaintiff, it was a creditor under state law, and therefore exempt from the requirement to provide the “mini-Miranda” notice under 15 U.S.C. 1692e(11).
